USE CLAUSE

The Premises may be used primarily: for the preparation and sale of (a) bakery products and (b) pastry and viennoiserie products; and secondary: for (c) coffee by the cup, (d) espresso/coffee/tea-based drinks, (e) teas and spices, (f) blended beverages, (g) bakery and pastry related equipment, supplies and accessories, (h) seasonal, promotional and Tenant-branded merchandise, (i) assorted food items, including, but not limited to, salads, sandwiches, juices, candies and novelties, (j) non-food items not presently prohibited by the exclusive use rights of other tenants in the Building as of the date of this Letter of Intent and disclosed to Tenant in writing, and (k) other items made available for sale in the ordinary course of business not prohibited by the exclusive use rights of other tenants in the Building as of the date of this Letter of Intent and disclosed to Tenant in writing.
